IN NO EVENT SHALL HANGRY JOE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO HANGRY JOE'S IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

The limitations of liability set forth above are fundamental elements of the basis of the bargain between Hangry Joe's and you. Some states do not allow limitations on implied warranties or exclusion of certain damages, so some of the above limitations may not apply to you.

16. Dispute Resolution and Arbitration

16.1 Informal Resolution

We will make good faith efforts to resolve the dispute within thirty (30) days of receiving your notice.

16.2 Binding Arbitration

If the dispute is not resolved through informal means within thirty (30) days, you and Hangry Joe's agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (including questions about the validity, scope, or enforceability of this arbitration agreement) shall be resolved by binding arbitration on an individual basis, rather than in court. The arbitration will be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. YOU AND HANGRY JOE'S EXPRESSLY AGREE THAT ANY ARBITRATION OR OTHER LEGAL PROCEEDING SHALL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. You waive any right to bring claims as a class representative or class member. If a court or arbitrator determines that this class action waiver is unenforceable, then the arbitration provision above shall be null and void as to such claims.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Nothing in this section shall limit either party's ability to file a complaint with the FTC or any other applicable regulatory authority.
